DWI / DUI Penalties

The penalties for driving while intoxicated or under the influence are as follows:

Driving Under the Influence (DUI)-Class C Misdemeanor

Penalties are

Fine up to $500.00
Community Service-20-40 hours
Alcohol awareness class or equivalent
Note: Each case is different and additional terms and conditions of probation could be required.

Driving While Intoxicated 1st-Class B Misdemeanor

Penalties are

72 hours to 180 days in the county jail (Jail sentence can be probated up to two (2) years)
Fine up to $2,000.00
Community Service-20 to 100 hours

Driving While Intoxicated 2nd-Class A Misdemeanor

Penalties are

30 days to 1 year in the county jail (Jail sentence can be probated up to two (2) years)
Fine up to $4,000.00
Community Service-80 to 200 hours

Driving While Intoxicated with Child in Car Under the Age of 15 –State Jail Felony

Penalties are

180 days to 2 years in a State Jail Facility (State Jail sentence can be probated up to five (5) years)
Fine up to $10,000.00
Community Service-120 to 400 hours

Driving While Intoxicated 3rd -3rd Degree Felony

Penalties are

2-10 years in the Institutional Division of the Texas Department of Criminal Justice (TDC) (Prison sentence can be probated up to ten (10) years)

Community Service-160 to 600 hours

Intoxication Assault-3rd Degree Felony

Penalties are

Intoxication Manslaughter-2nd Degree Felony
