According to Texas law, sexual contact is defined as any touching by an individual, including touching through clothing, a child’s anus, breast, or any part of the child’s genitals with the intent to arouse or gratify the sexual desire of any person. Indecency with a child by contact is a second-degree felony, punishable by a maximum prison sentence of 20 years and a fine of up to $10,000.
On the other hand, indecency with a child by exposure occurs when a person exposes the anus or any part of the genitals in the known presence of a child or causes the child to expose his or her anus or any part of their genitals with the intention to sexually arouse or gratify the sexual desire of any person. This criminal offense is considered a third-degree felony, punishable by a maximum prison sentence of ten years and a fine of up to $10,000.
